Customer Agreement
This Customer Agreement (“Agreement”) is between Luca, LLC, 400 Rafael Lamar, Urb. Ext. Roosevelt, San Juan PR 00918, (referred to as “LUCA”), Customer and User
- In General
- The Customer and User are entering into this Customer Agreement as a condition to use one or more of the Luca Center Services (“Products” or “Services”) acquired through an Order Form.
- Authorized User:
- Products may be accessed and used only by individuals authorized by LUCA as the intended user (“User(s)”).
- The owner of the account will be the User even though the Customer (person or entity making the payments) is a different person.
- Customer will provide to LUCA, the names and addresses of each User.
- Customer agrees to and shall comply with, and shall ensure that Users agree to and comply with, the terms of this Agreement and any other applicable terms and conditions governing website access set forth on and referenced as part of the Terms of Service designated by LUCA from time to time, as posted on a Product’s webpage. User’s use of the Products constitutes acceptance of all terms and conditions contained herein, and the terms and conditions included in LUCA webpage through the following documents:

- Payment Methods. To use the Luca Center services you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details.
- Updating your Payment Methods. You can update your Payment Methods by going to your account or by telephone at (787) 236-9609. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
- Fees and Payment. LUCA will send all Customer invoices to a single designated email address. Product fees do not include applicable taxes, which will be included on the invoice. Unless Customer provides LUCA with a valid signed tax exemption certificate, Customer agrees to pay sales and other applicable taxes.
- Customer is responsible for purchasing any equipment, software, communications and access through third party online vendors that may be necessary to access and use the Products.
- Memberships
- Membership Plans.
- We may offer several membership plans, including special promotional plans or memberships offered by third parties in conjunction with the provision of their own products and services.
- We are not responsible for the products and services provided by such third parties. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you.
- Services Included in our Membership Plans.
- Gold Membership Plan: LUCA grants to User for one year a non-exclusive, non-transferable, limited right to access and use our webinar and live-seminars sections. This Membership Plan includes 40 Continuing Education Credits.
- Silver Membership Plan: LUCA grants to User for one year a non-exclusive, non-transferable, limited right to access and use our live-seminars sections. This Membership Plan includes 28 Continuing Education Credits.
- Bronze Membership Plan: LUCA grants to User for one year a non-exclusive, non-transferable, limited right to access and use our live-seminars sections. This Membership Plan includes 12 Continuing Education Credits.
- Free Membership Plan: This plan does not include any access to our webinar and live-seminars sections. Also, this Membership Plan does not include any Continuing Education Credits.
- Continuing Education Credits:
- To receive Continuing Education Credits, you must: (1) register for the live-seminar or the webinar prior to the start of each program and login no later than the scheduled start time for the event, and/or (2) complete all the requirements impose by Luca Center, such as answer the polling questions, complete all quizzes, confirm your attendance via codes, among other.
- Continuing Education Credits that are not used during the subscription period included with your Membership Plan will be lost and cannot be transfer to other billing cycle.
- Other Discretionary Services: Luca Center may offer additional “Discretionary Services”, that may vary from time to time among Membership Plans. These “Discretionary Services” will not be considered part of the Membership Plans and Luca Center reserves the right to change, suspend, or discontinue temporarily or permanently, some or all of these (including the Content and the devices through which the Services are accessed), with respect to any or all Membership Plan, at any time without notice. Some of these “Discretionary Services” are:
- News & Publications: Notifications and information related to the latest news and developments.
- Community: Access to our community area, so you can expand your networking opportunities.
- Job Management: Access to our Job Management area, so you can upload a resume, create job alert emails, search for jobs, save them and apply to them directly.
- Discounts: Discounts on products from third parties.
- Other Content: Access to our business templates section, calendar, financial calculators, and seminars material, among other.
- Billing Cycle. The membership fee for the Luca Service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific billing date. The length of your billing cycle will depend on the type of subscription that you choose when you sign-up for the service. Membership fees are fully earned upon payment. In some cases, your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month.
- Your Luca Center membership will continue and automatically renew until terminated. To use the Luca Center service, you must have Internet access and a Luca Center ready device and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time and which may include payment through your account with a third party. You must cancel your membership before it renews in order to avoid billing of the membership fees for the next billing cycle to your Payment Method (see “Cancellation” below).
- Cancellation of Service. LUCA reserves the right to immediately terminate User’s access to the Products, without further notice, if LUCA does not receive the payment. Also, you can cancel your Luca Center membership at any time, and you will continue to have access to the Luca Center service through the end of your billing period. To cancel, go to your account or contact Customer Service Support by telephone at (787) 236-9609. If your membership is cancelled, your account will automatically be switched to a Free Membership Plan at the end of your current billing period.
- Changes to the Price and Subscription Plans. We reserve the right to change our subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly, any price changes or changes to your subscription plan will take effect following notice to you.
- No Refunds. Payments are nonrefundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
III. Upgrades and Downgrades
- A plan upgrade takes effect immediately, and you will be charged the new price on your purchase. Your membership subscription will not be extended, and therefore, your next billing date will remain unchanged.
- A plan downgrade takes effect on your next billing date, and you will be charged the new price on your next billing date.
- Live Seminars and Online Seminars
- Live Seminars:
- Luca Center grants User a non-exclusive, non-transferable, limited license to assist to any Live Seminar purchased, and to use the Seminar Materials.
- User is otherwise prohibited from reproducing, transmitting, displaying, printing, copying, or distributing the Seminar Materials.
- All right, title, and interest (including all copyrights and other intellectual property rights) belong to Luca Center or its third party suppliers. The Customer and or the User acquires no ownership of copyright or other intellectual property rights or proprietary interest in the Services, or copies thereof.
- Except as specifically provided herein, the Customer and or the User may not use the Services in any fashion that infringes the copyright or proprietary interests therein.
- The Customer and or User may not remove or obscure the copyright notice or other notices contained in the Services.
- Online Seminars:
- Luca Center grants User a non-exclusive, non-transferable, limited license to access and use the Webinar Materials from time to time made available to the User.
- This license is subject to the following limitations: (1) The right to electronically display Webinar Materials is limited to the display of such Webinar Materials primarily to one person at a time; (2) The right to obtain a printout of the Webinar Materials is limited to a printout of a reasonable portion of the Webinar Materials; and (3) The right to retrieve and store machine-readable copies of the Webinar Materials is limited to the retrieval of a single copy of a reasonable portion of the Webinar Materials and storage of that copy in machine readable form, primarily for one person’s exclusive use, to the extent the storage of those Webinar Materials is not further limited or prohibited by any additional terms.
- User is otherwise prohibited from downloading, storing, reproducing, transmitting, displaying, printing, copying, or distributing the Webinar Materials. All access to and use of the Services via mechanical, programmatic, robotic, scripted or any other automated means not provided as part of the Customer Agreement is strictly prohibited.
- All right, title, and interest (including all copyrights and other intellectual property rights) belong to Luca Center or its third party suppliers. The Customer and or the User acquires no ownership of copyright or other intellectual property rights or proprietary interest in the Services, or copies thereof.
- Except as specifically provided herein, the Customer and or the User may not use the Services in any fashion that infringes the copyright or proprietary interests therein.
- The Customer and or User may not remove or obscure the copyright notice or other notices contained in the Services.
- Other Purchases
- Customer may purchase additional educational or non-educational content, such a seminar materials and Continuing Education Credits, among other (“Other Content”).
- Payments for the acquisition of Other Content are nonrefundable and there are no refunds or credits for partially used products or services.
- Disclaimer of Professional Advice
- The information provided through the Products is not and shall not be construed as tax, accounting, audit, consulting, legal, regulatory or other professional advice or sufficient to satisfy any tax, accounting, legal, regulatory or other professional requirements and not necessarily is updated. Customer and/or each User should consult tax, accounting, legal, regulatory or other professional advisor(s) for advice. None of the Products nor any related services or any portion thereof shall constitute or be construed as (a) a solicitation, offer, opinion or recommendation by LUCA, its affiliates or any supplier, for any transaction in any financial instrument, including but not limited to securities, (b) providing legal, financial, tax, accounting or investment advice or recommendations, other professional service, or (c) forming an attorney-client relationship.
VII. Miscellaneous Provisions
- Each Product contains proprietary content and/or software protected by copyright and other similar laws. LUCA and its licensors retain all rights in the Products, including (without limitation) all copyright and other proprietary rights worldwide in all media.
- Permitted Uses. Users may access and use the Products solely for their own internal business purposes as permitted herein. Users shall not share usernames and passwords. Customer and User agrees to notify LUCA promptly in writing of any known or suspected unauthorized use of the Products or any known or suspected breach of security, including but not limited to, loss, theft, or unauthorized disclosure of usernames and passwords.
- In no event may Customer or a User copy or distribute any Product in its entirety, or systematically, routinely or regularly, copy and/or redistribute copies of individual articles, LUCA Highlights, table of contents, indexes, or other LUCA finding aids. Customer and Users may not reproduce, create derivative works from, perform, publish, transmit, distribute, sell (or participate in any sale), or otherwise access, use, or exploit any material retrieved from or contained in the Products in any manner whatsoever that may infringe any copyright or proprietary interest of LUCA or any third party; store any content from the Products in any information storage and retrieval system; distribute the information contained in the Products to any person who is not duly authorized to use or receive the Products; distribute, rent, sublicense, lease, transfer or assign the Products or this Agreement; decompile, disassemble, or otherwise reverse-engineer the Products, or alter, translate, modify, or adapt the Products to create derivative works; make use of “framing” or other means of redirecting content; place or install any portion of the Products on any electronic media, including, but not limited to, local or wide area networks or intranets, timesharing services, multiple processing units, multiple site arrangements, service or software rental bureaus, list servers, online services, electronic bulletin boards or forums, websites, or any other server that is Internet-enabled. Notwithstanding anything to the contrary in this Agreement, if LUCA believes, in its sole good faith judgment, that any provision of this Agreement has been breached by Customer or a User, LUCA reserves the right to suspend access to and use of the Products, or any portion thereof, at any time without notice effective immediately.
- Other Representations and Limited Warranty.
- LUCA represents and warrants that it has the right to make the Products available to User under this Agreement. User represents and warrants that its use of the Products shall comply with all applicable laws, rules and regulations.
- EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT, ALL PRODUCTS ARE PROVIDED TO CUSTOMER AND USER “AS IS.” CUSTOMER AND USER SHALL INDEMNIFY, HOLD HARMLESS AND AT CUSTOMER’S AND USER’S EXPENSE DEFEND LUCA AND ITS AFFILIATES AND THEIR SUPPLIERS AGAINST ANY AND ALL LOSSES, CLAIMS, DEMANDS OR EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF THE PRODUCTS OR ANY CONTENT CONTAINED THEREIN.
- Not with standing any limitations contained in this Agreement, LUCA shall indemnify and hold Customer harmless and shall defend or settle any claim, suit or proceeding brought against Customer that is based upon a third-party claim that the content contained in the Products infringes a United States copyright or violates an intellectual or proprietary right protected by a Puerto Rico or United States law (“Claim”), provided that (a) Customer shall notify LUCA in writing of any Claim within ten (10) calendar days after Customer first receives notice of the Claim, (b) LUCA shall have sole control over any Claim (including without limitation the selection of counsel and the right to settle on behalf of Customer on any terms LUCA deems desirable in the sole exercise of its discretion) and (c) Customer shall provide to LUCA at no cost such assistance and cooperation as LUCA may reasonably request from time to time in connection with the defense of the Claim. Customer may, at its sole cost, retain separate counsel and participate in the defense or settlement negotiations. LUCA shall pay actual damages and costs awarded against Customer (or payable by Customer pursuant to a settlement agreement) in connection with a Claim. If a Product or its use becomes the subject of a Claim or its use is enjoined, or if, in the opinion of LUCA’s legal counsel, the Product is likely to become the subject of a Claim, LUCA shall attempt to resolve the Claim by using commercially reasonable efforts to modify the Product or obtain a license to continue using the Product. If, in the opinion of LUCA’s legal counsel, the Claim, injunction, or potential Claim cannot be resolved through reasonable modification or licensing, LUCA, at its own election, may terminate the Agreement, in whole or in part, the applicable Order Form and/or the applicable Product Subscription without penalty, and will refund to Customer the pro-rata portion of any fees for the infringing Product paid in advance by Customer to LUCA and attributable to any post-termination period. LUCA shall have no obligations under this paragraph if the Claim is based on (i) additions, changes or modifications to the Product, (ii) a combination of material, content, products or software not provided by LUCA or (iii) use of the Product other than as expressly permitted by this Agreement. THE FOREGOING CONSTITUTES LUCA’S SOLE AND EXCLUSIVE LIABILITY FOR INTELLECTUAL PROPERTY INFRINGEMENT.
- Customer acknowledges that the Products (and the content contained therein) are highly proprietary in nature and agrees that unauthorized copying, transfer or use may cause LUCA, its affiliates and their suppliers’ irreparable injury that cannot be adequately compensated for by means of monetary damages. Customer agrees that LUCA and its affiliates may enforce any breach of this Agreement by Customer or any User by means of equitable relief (including, but not limited to, injunctive relief) in addition to any other available rights and remedies. Unauthorized reproduction, transfer, and/or use may be a violation of criminal as well as civil law.
- LUCA is not responsible for the opinions or expressions made by our contributing writers or in any content or publication posted on the site.
- The technical assistance provided by LUCA will be limited only to general questions and is not obligated to answers all questions submitted by the public. LUCA reserves the right to determine the questions that will be answered, within the scope of interest of its members. Also, LUCA reserves the right to post any information on the site. LUCA is not responsible for the correctness or use given to the information contained on the LUCA site.
- LUCA reserves the right to turn down, or not to answer, highly technical questions.
- Limitation of Liability. IN NO EVENT SHALL LUCA, ITS AFFILIATES AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS OR REPRESENTATIVES (“LUCA GROUP”) HAVE ANY RESPONSIBILITY OR LIABILITY, CONTINGENT OR OTHERWISE, FOR ANY INJURY OR DAMAGES AND/OR BE LIABLE TO CUSTOMER, ANY USER, OR ANY OTHER PERSON FOR ANY LOST PROFITS, LOSSES, SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF GOODWILL IN ANY WAY RELATING TO THE USE OF THE PRODUCTS OR THE PERFORMANCE OR NON-PERFORMANCE OF ANY OBLIGATIONS UNDER THIS AGREEMENT, INCLUDING THE FAILURE OF ESSENTIAL PURPOSE, EVEN IF CUSTOMER, USER, OR OTHER PERSON HAS BEEN NOTIFIED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES OCCURRING. IF THE FOREGOING LIMITATIONS ARE HELD TO BE UNENFORCEABLE, LUCA GROUP’S LIABILITY FOR DAMAGES UNDER THIS AGREEMENT TO CUSTOMER, ANY USER, OR ANY OTHER PERSON SHALL IN ANY EVENT NOT EXCEED THE AMOUNT OF THE FEES FOR THE APPLICABLE PRODUCT SUBSCRIPTION PAID BY CUSTOMER FOR THE ONE (1) YEAR PERIOD IMMEDIATELY PRECEDING THE OCCURRENCE OF THE ALLEGED INJURY OR DAMAGE. IN NO EVENT MAY CUSTOMER OR ANY USER BRING ANY CLAIM OR CAUSE OF ACTION AGAINST THE LUCA GROUP MORE THAN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION ARISES.
- Term and Termination. The term of this Agreement shall begin on the date that Customer is provided with access to a Product and shall remain in effect until all subscriptions to Products ordered pursuant to this Agreement (“Product Subscription(s)”) have been terminated (the “Term”), unless earlier terminated in accordance with the terms herein. The term of each Product Subscription and any renewal thereof shall be as set forth on an Order Form and/or invoice (each, a “Product Subscription Term”). LUCA may immediately terminate this Agreement, an Order Form, and/or the applicable Product Subscription (and Customer or User will not have any rights to requests a refund) if Customer or User breaches any provision of this Agreement. Customer may terminate the applicable Product Subscription if LUCA materially breaches any provision of this Agreement and fails to remedy such breach within sixty (60) days after written notice of such breach. Either party may terminate this Agreement if the other party has any proceedings instituted by or against it seeking relief, reorganization or arrangement under any laws relating to insolvency, or any assignment for the benefit of creditors, or the appointment of a receiver, liquidator or trustee of any of its property or assets, or the liquidation, dissolution or winding up of its business. Notwithstanding the foregoing, LUCA may immediately terminate the Agreement without further notice if it reasonably believes that the Customer or User have engaged in activity that violates applicable law. The Order Forms shall terminate upon the termination of this Agreement, but the termination of any Order Form shall not itself terminate this Agreement. All obligations with respect to any money that was accrued and owing prior to the effective date of any termination under this Agreement shall survive termination. All terms included in this Customer Agreement, as well as all the Exhibits, that protects Luca Center shall survive any termination of this Agreement and shall continue in full force and effect.
- Discontinuation of Product. In the event LUCA discontinues a Product, LUCA will offer a comparable LUCA product to Customer or User. If no product is available, or if Customer or User does not accept the offered product, LUCA will provide either a pro rata credit or a refund of the unused portion of fees paid for the discontinued Product. LUCA reserves the right to revise or discontinue certain Product features or content. In such case, LUCA will use reasonable efforts to notify Customer User to the extent LUCA believes, in its good faith discretion, that any such revision or discontinuance will have a material and adverse effect on Customer’s or User’s use of the Product.
- Force Majeure. LUCA shall not be liable for failure to perform any part of this Agreement where such failure is due to fire, flood, power outages, strikes, war (declared or undeclared), acts of terror, embargoes, blockages, legal restrictions, governmental regulations or orders, riots, insurrections, Act of God, or any cause beyond the control of LUCA. In such event, LUCA shall use reasonable efforts to resume performance. This Agreement shall not be regarded as terminated or frustrated as a result of such failure of performance not exceeding three (3) months and the parties shall proceed under this Agreement when the causes of such non-performance have ceased or have been eliminated.
- Notices. Notice under this Agreement shall be made in writing; sent via certified mail, return receipt requested, or a nationally recognized overnight courier service; effective upon receipt at the address stated below; and addressed as follows: If to LUCA, to 400 Rafael Lamar, Urb. Ext. Roosevelt, San Juan PR 00918. If to Customer, to the designated billing contact and address.
- 14.1 No Waiver. Should LUCA fail to exercise or enforce any provision of this Agreement or to waive any rights in respect thereto, such waiver or failure shall not be construed as constituting a continuing waiver or waiver of any other right.
- Choice of Law. This Agreement shall for all purposes be governed and construed in accordance with the law of the Commonwealth of Puerto Rico without regard to its choice-of-law rules. The parties, and their successors and assigns, agree to submit to the jurisdiction of each of the federal and state courts located in San Juan, Puerto Rico, in connection with any matters arising out of or relating to this Agreement, and waive any objection to such venue, including forum non conveniens, sovereign immunity, Act of State or analogous doctrines.
- Entire Agreement. Unless otherwise specified in the applicable Order Form, this Agreement, as it may be amended from time to time, constitutes the entire agreement between each Customer, User and LUCA, and supersedes all prior or contemporaneous writings, discussions, agreements, and understandings of any kind, with respect to the subject matter of this Agreement.
- Severability. If any provision of this Agreement is held to be unenforceable, the parties shall renegotiate those provisions in good faith to be valid, enforceable substitute provisions, which provisions shall reflect as closely as possible the intent of the original provisions of this Agreement. If the parties fail to negotiate a substitute provision, this Agreement will continue in full force and effect without that provision and will be interpreted to reflect the original intent of the parties.
- Third Party Beneficiaries. All beneficial rights (other than the right to collect fees) granted to or reserved in this Agreement by LUCA, including limited warranty, limitation of liability, remedies, indemnification, confidentiality, and ownership, shall accrue to and are for the benefit of licensors and suppliers to the same extent as LUCA. Except as expressly stated herein, nothing contained in this Agreement is intended to create third party beneficiaries thereof.
- Each Party Acting Independently. LUCA, User and Customer agree that each is acting independently of the other, that they are not joint venturers, and that neither is an agent, partner, or joint venturer of the other.
- Amendment and Assignment. Except as otherwise expressly set forth herein, neither this Agreement nor any Order Form shall be changed, modified, or amended except by a writing signed by a duly authorized representative of LUCA, User and the Customer. Neither party may assign this Agreement or any rights or obligations created under this Agreement without the prior written consent of the other party, which consent will not be unreasonably withheld, except that LUCA may assign this Agreement without consent (i) to any subsidiary or affiliated company, (ii) to an entity succeeding to all or substantially all of its stock or assets, whether by merger or purchase, provided that such entity shall expressly assume all of LUCA’s obligations under the Agreement, or (iii) in the event LUCA sells or otherwise transfers a Product to a third party. Customer and User acknowledge and agree that LUCA may delegate certain of its responsibilities, obligations and duties under or in connection with this Agreement to a third party or an affiliate of LUCA, which may discharge those responsibilities, obligations and duties on behalf of LUCA. With respect to any such delegation, LUCA will be responsible and liable for any breach of this Agreement by the third party or affiliate if and to the same extent LUCA would be responsible and liable pursuant to this Agreement if it had committed such breach directly. Any unauthorized assignment or delegation will be null and void. Subject to the foregoing, this Agreement will be binding upon and inure to the benefit of the parties’ successors and assigns.
- Headings and Cross-References. The headings in this Agreement are for convenience of reference only and shall not limit or otherwise affect the scope, meaning or intent of the provisions of this Agreement.
- Changes to this Agreement. LUCA reserves the right to make changes to any part of this Agreement without prior notice. Continued use of any Product following any such change will constitute acceptance of those changes.

Introduction
This is an agreement between you or the entity that you represent (hereinafter “User”, “you” or “your”) and Luca, LLC, including its subsidiaries or related/affiliated entities (hereinafter the “Company”) governing your use of our websites and services (“Services”).

It is your responsibility to ensure that your Guest Collaborator complies with privacy standards that are no less stringent than our own.
When you use certain Services, you have the option to share information with other accounts you have signed up for. Purposes may include saving copies of records, importing data from external sources, communications with third parties, and conducting payment and direct deposit functions, among others. When the Company services some data is cached in the memory of the device. If the application is put in the background without closing, the data may remain in the cache. We take no responsibility for any unauthorized viewing of this data by third parties.
Children’s Privacy
If you learn that a minor has provided us with personal information without a lawful guardian or parent’s lawful consent, you may alert us at info@lucacenter.com. If we learn that we have unlawfully collected any personal information from minors, we will promptly take steps to delete such information and terminate the minor’s user account.

The Company relies on you to ensure that the Personal Information you provide to us while using the Services is as accurate, complete and up-to-date as necessary for the purposes for which it is to be used. What is copyright?
The copyright laws give LUCA (as the copyright owner) the exclusive right to reproduce, prepare derivative works, distribute, perform, and publicly display a copyright work. The laws are intended to protect the owner’s intellectual property in the work, and to protect print and electronic works, such as publications, books, Web-based applications, videos, and software. Works are protected even if they are not registered with the U.S. Copyright Office, or do not carry the copyright symbol “©”. Generally, copying of copyrighted materials is not allowed, whether done by photocopying or electronic means (e.g., e-mailing or faxing an article), unless permission or license has been obtained or the copying falls under an exception such as “fair use,” as defined by the copyright laws, for purposes such as criticism, comment, background research, or teaching.
Consequences for Infringement
All LUCA products contain proprietary content and/or software that are protected by copyright and other similar laws. LUCA claims copyright protection for all material that has been written or enhanced as a result of the efforts of LUCA’s editorial staff or indexers. LUCA does not claim copyright in United States government works, although LUCA does claim copyright for the compilation, selection, coordination, and arrangement of such material. Put simply, except for statutory exceptions such as “fair use,” no portion of a LUCA product may be reproduced in any way, unless expressly permitted. Infringement may result in criminal as well as civil liabilities for you and your employer.
Copy, e-mail, or fax an entire (or part) issue of a publication
You may never make copies of or transmit part or the entire contents of a LUCA publication, even if you have a membership with the LUCA. It does not matter whether the publication is in print or electronic form or if the copying or transmission is done on a one-time basis.

The Company respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, U.S. Copyright Act 17 U.S.C. 512(c)(3) and regulations promulgated thereunder, each as amended, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, the Company will respond expeditiously to claims of copyright infringement committed using the Company service and/or the Company website if such claims are reported to the Company Designated Copyright Agent identified in the notice below.

Alcance
Favor de leer en adición las reglas de uso sobre Luca+, las cuales también serán de a nuestras secciones de Grupos y Foros.
Objetivos
LUCA, LLC (“Luca”) ha creado mecanismos de comunicación como lo son las redes sociales, la sección de “Grupos”, así como la sección del “Foro de Consultas” (todos los mecanismos de comunicación serán denominados como el “Foro”) exclusivamente con el objeto de ofrecerle a cualquier usuario de la página de internet un espacio en donde puedan expresar sus dudas, opiniones y/o preocupaciones relacionada al campo empresarial (finanzas, contabilidad, corporativo, sucesiones, contributivo, entre otros) así como fomentar la participación y la obtención de información y opinión de los demás usuarios interesados en esta materia.
El Foro podrá estar compuesto por chats, video-conferencia, blogs, o cualquier otro medio de apoyo que Luca así lo estime conveniente.
Para fines de este documento titulado “Reglas de Uso: Foros”, el término usuario incluye no solo a los miembros con acceso al sistema para realizar preguntas y/o comentarios, sino que también incluye a:
- Cualquier usuario que sea miembro sin acceso a preguntar y/o comentar.
- Cualquier usuario que no sea miembro de Luca pero que tenga acceso al contenido del mismo.
- Cualquier personal asignado por Luca para comentar en las distintas entradas (“moderador”).
Ausencia de Asesoramiento
Sin perjuicio de la participación de los usuarios, es posible que un moderador participe en el Foro y en la creación de determinados contenidos. Sin embargo, los artículos y contenidos del Foro contienen información procedente tanto de fuentes propias como de terceros. Luca procura que los contenidos colgados por los usuarios, incluyendo sus moderadores, sean de la mayor calidad posible y estén razonablemente actualizados, pero no garantiza la utilidad, exactitud, exhaustividad, pertinencia y/o actualidad de tales contenidos. Asimismo, Luca no se hace responsable ni verifica la veracidad y fiabilidad de los contenidos ni de la información técnica proporcionada por los usuarios a través del Foro.
Salvo que se especifique lo contrario de manera expresa, un moderador que participe en el Foro expresará exclusivamente sus opiniones personales y experiencias a propósito de los temas en debate, sin que pueda entenderse que los mismos están comunicando ninguna opinión oficial de Luca.
Por todo lo anterior, la inclusión de contenidos en el Foro no constituye en modo alguno la prestación por parte de Luca de ningún servicio de asesoramiento. Luca no aconseja al usuario la toma de decisiones sobre la base de la información recogida en los contenidos sin obtener un asesoramiento profesional adecuado.
Interpretación de los comentarios
Las opciones, comentarios y/o preguntas realizadas por un moderador en este Foro no tienen la intención ni el propósito de ser utilizado para la evasión contributiva a nivel local ni federal.
El moderador comentará en el Foro analizado única y exclusivamente los hechos y circunstancias provistas por el usuario. Además, sus comentarios representan y están basados en el propio entendimiento del moderador, no de Luca, de las provisiones y aplicación de las leyes de Puerto Rico.
A través de los escritos los usuarios encontrarán recomendaciones que podrían ser interpretadas como conclusiones relacionadas a un curso de acción en particular cuando en realidad las mismas deberán ser interpretadas dentro de un margen de probabilidad de ocurrencia, es decir, que al ver palabras conducentes a conclusiones de acciones como “realizará” se debería interpretar como un “lo más probable”.
Es importante recordar que el contenido de este Foro no obliga ni es vinculante a las autoridades contributivas de Puerto Rico, como el Departamento de Hacienda, el Servicio de Rentas Internas Federal, ni los Tribunales de Justicia, y no garantiza determinaciones favorables a ser tomadas por estas. Más aun tampoco aseguramos que determinaciones legislativas o administrativas de aplicación retroactiva afecten lo establecido en este escrito. Asimismo, el usuario es consciente y acepta que los comentarios que incluya en el Foro se podrán difundir a través de Internet y que, por tanto, éstos podrán ser accedidos por cualquier tercero en todo el mundo e incluso podrán ser objeto de indexación a través de diversos motores de búsqueda.
Contenido de los Comentarios
El Foro pretende ser una herramienta de participación para todos los usuarios interesados en temas empresariales. El usuario deberá tenerlo en cuenta a la hora de escribir sus mensajes, haciéndolos claros, simples y fácilmente entendibles. A estos efectos, Luca propone a los usuarios las siguientes recomendaciones:
- Trate de adecuar su mensaje a cada entrada y a los temas específicamente tratados en cada caso.
No se debe usar el Foro como canal de “chat”.
- Los mensajes que se publican deben ser de interés general y no para comunicarse entre un grupo reducido de usuarios.
- Cualquier usuario que comente los productos y servicios de Luca o que participe en el Foro tiene capacidad de influir en la reputación, marca e imagen de Luca. Se le solicita prudencia al respecto.
El sentido común y las reglas y los principios que se enumeran en este documento servirán de guía en la actuación del usuario.
Conductas y Contenidos Prohibidos
Queda prohibido y el usuario no deberá en ningún caso:
- Utilizar el Foro con fines ilícitos o distintos de los previstos en las presentes reglas.
Infringir a través del Foro normativa alguna (incluyendo la comisión de delitos) ni inducir a terceros a infringir.
- Compartir a través del Foro información confidencial ni que sea propiedad de terceros (por ejemplo, de su empleador o de la competencia).
- Proporcionar información basada en rumores o especulaciones, en vez de en hechos demostrables.
- Utilizar el Foro para plantear a Luca o a terceros cuestiones concretas o dudas o exponer críticas sobre productos o servicios de Luca o de terceros. Existen vías no públicas y específicas habilitadas para estos fines como. Para estos fines, puede comunicarse a nuestro servicio al cliente por email a info@lucacenter.com o teléfono al 787-236-9609.
- Suplantar la identidad de terceros ni expresar opiniones en nombre de terceros sin la debida autorización.
- Luca tiene designados portavoces oficiales. Salvo que se trate de uno de dichos portavoces, el usuario deberá dejar claro que cualquier opinión o recomendación que exprese lo hace a mero título personal.
- Los usuarios tampoco deben emitir opiniones en nombre de terceros ni utilizar logos o marcas de terceros sin su autorización.
- Incluir materiales de terceros (ya sean texto, materiales gráficos, audiovisuales, logos, links o materiales de cualquier tipo) sin la correspondiente autorización de los titulares de los derechos de propiedad intelectual, industrial o de cualquier otro tipo sobre los materiales.
- Se prohíbe el uso de expresiones racistas, étnicas, políticas, políticas partidistas y sexuales que sean detrimentales o que muestren discrimen de algún tipo.
- Está prohibido que alguien represente o actúe haciendo falsa representación de ser moderador del Foro cuando no ha sido designado por Luca. Persona que se descubra haciendo esto será totalmente eliminada de participar en el Foro y no tendrá derecho a reembolso alguno por la cantidad pagada por la membresía.
- Está prohibido que alguien represente o actúe haciendo falsa representación de ser otro subscriptor de Luca emitiendo comentarios en el Foro. Persona que se descubra haciendo esto será totalmente eliminada de participar en el Foro y no tendrá derecho a reembolso alguno por la cantidad pagada por la membresía.
Monitorización del Foro
Luca podrá dedicar esfuerzos razonables a velar por el buen uso del Foro. En particular, Luca se reserva el derecho, a su exclusivo criterio, de monitorizar el uso del Foro y la facultad de no colgar, de modificar parcialmente o de retirar aquellos comentarios o materiales incluidos o propuestos por los usuarios que Luca considere conveniente. Además, los usuarios eximen a Luca de cualquier responsabilidad por dicha retirada o modificación o por la falta de retirada o modificación de cualesquiera comentarios o contenidos.
Por ejemplo, y sin ánimo de exhaustividad, Luca se reserva el derecho de modificar o retirar cualquier comentario introducido en el Foro que:
- Incumpla las presentes reglas o los siguientes documentos: “Terms and Conditions”, “Privacy Policy”, “Intellectual Property Policy”, “Cookies Statement” y el “Contrato de Servicios”.
- No se refiera específicamente a materias relativas al campo empresarial ni se atenga a los objetivos del Foro.
- No respete los dos principios básicos que deberán regir este Foro: el respeto de las personas y de sus ideas.
- Incluya lenguaje ofensivo, contenido ilegal, comercial o spam.
- Contenga comentarios que puedan, a criterio de Luca, suponer un ataque personal o insultos a Luca o a cualquier tercero o infrinja cualquier otra normativa.
- Exista cualquier sospecha o indicio de que infringe derechos de propiedad intelectual o industrial de Luca o de terceros.
- Expresen mensajes publicitarios no autorizados dentro de las entradas del Foro.
Si usted encuentra un comentario en el Foro que no pertenece al tópico correspondiente o encuentra que el comentario viola alguna de las reglas o guías de los Foro, deberá utilizar el correo electrónico y comunicarse con el moderador de forma privada informándole sobre lo sucedido. Se le agradece que no entre en contacto directo con la persona que hizo el comentario ni trate de hacer algo relacionado al comentario.
Durante la Sesión
El moderador se reserva el derecho de expulsar o dar por terminada una sesión de apoyo, sin previo aviso, a quien no respete las políticas de uso.
Los moderadores del Foro se reservan el derecho, y sin previo aviso, de revisar todo material o comentarios, editar el contenido, borrar contenido, reclasificarlos según encuentre necesario dado que el contenido no es apropiado, puede causar interrupción de servicio o está en violación a las reglas aquí descritas.
Por seguridad del usuario, por este canal de atención no se brindará información confidencial de los participantes, contraseñas o cualquier otra que implique la verificación de la autenticidad del usuario y de la información.
El contenido del Foro será moderado en términos de cantidad y extensión de los mismos. El contenido será accesible por un periodo de tiempo discrecional para preservar lo largo y el tiempo que haya transcurrido para cada tema.
Acerca de Borrar o Actualizar Información
Una vez que se ha hecho público un mensaje en el Foro, puede ser que no sea posible modificarlo o borrarlo. Las entradas en el Foro podrán contar con un moderador quien se reserva el derecho de retirar o dar por terminada la entrada, sin previo aviso, a quien no respete las políticas de uso.
Otros
Luca, LLC se reserva el derecho de cambiar, modificar, añadir o eliminar reglas del Foro sin previo aviso.

Objetivos
Nuestra sección de Luca Laboral fue diseñada tanto para ayudarlo a publicar ofertas de empleo, así como para publicar su resume. En esta sección estaremos describiendo las Reglas de Uso aplicables a esta.
Reglas de Usos Relacionadas a las Ofertas de Empleos (Empleos)
Contenido de las Publicaciones
Una oferta de empleo se caracteriza por ofrecer a los candidatos un empleo con un puesto vacante definido e inequívoco, en un municipio o ciudad concreta y clasificada en una categoría específica. Por ello, en el momento de crear una oferta de empleo es importante definir con cuidado el puesto vacante, municipio o ciudad del trabajo, así como cualquier otra información requerida para la correcta categorización de la misma. Dicha información podrá ser modificado por el empleador de tiempo en tiempo.
Tiempo de Publicación
Las ofertas estarán publicadas en nuestro portal durante el tiempo de publicación que así determine Luca Center. En este tiempo, se podrá desactivar y activar de nuevo la oferta en cualquier momento, tantas veces como sea necesario.
Legalidad de las Publicaciones
Las ofertas de trabajo publicadas tienen que ser totalmente legales. No aceptamos ninguna oferta que discrimine a las personas por razón de raza, sexo, religión, opinión, nacionalidad, discapacidad o cualquier otra circunstancia personal o social. Tampoco serán admitidas aquellas ofertas que soliciten al candidato realizar algún tipo de pago, que estén promocionadas por empresas piramidales, que sean negocios o que estén relacionadas con la industria del entretenimiento para adultos o el ocio nocturno. Por último, quedarán descartadas las ofertas que soliciten la inscripción de menores sin el consentimiento de sus padres o tutores y resulten engañosas o contengan alguna ilegalidad contemplada en las leyes aplicables.
Calidad del Servicio
Las ofertas publicadas tienen que respetar la calidad del servicio ofrecido por Luca Center. Por este motivo, es preciso que las ofertas no puedan publicarse por duplicado (el mismo puesto de trabajo en la misma ciudad, aunque tengan una fecha distinta) y deben estar directamente vinculadas a vacantes ofrecidas por las empresas. Recuerda, por otra parte, que no es posible incluir enlaces que dirijan los candidatos a la sección de empleo de la web de su empresa. Cada vacante de empleo, además, deberá tener una oferta de trabajo.
Por último, la información contenida en las ofertas debe ser clara y concisa. Para ello, es requerido que se utilice un lenguaje profesional.
Responsabilidad del Empleados
Los responsables últimos sobre las vacantes publicadas en Luca Center son las empresas. Solo podrán ser utilizadas internamente para reclutar candidatos y no podrán venderse a terceras personas. Serán éstas las que se responsabilicen de los perjuicios y consecuencias derivadas. Luca Center quedará eximida de cualquier responsabilidad en este sentido. Recuerde que las empresas que publiquen ofertas de trabajo que violen cualquiera de estas condiciones serán retiradas de la página web.
Reglas de Usos Relacionadas a los Candidatos (Resumés)
Intervención de Luca Center
Luca Center no interviene en los procesos de selección de candidatos. Por consiguiente, nosotros únicamente ponemos en contacto a candidatos que buscan trabajo con empresas que tienen vacantes disponibles.
Solicitudes de Empleos
Luca Center se reserva el derecho de bloquear aquellas cuentas que se estén inscribiendo en ofertas de empleos de manera masiva respecto a comportamientos estándar de otros usuarios.
Personas Extranjeras
Para el caso de personas extranjeras, su registro en Luca Center está condicionado a que cumplan con todos los requisitos migratorios legales para trabajar en el territorio de Puerto Rico o Estados Unidos.
Consentimiento del Uso de la Información Provista
El usuario de Luca Center otorga consentimiento expreso e informado, para que la información que brinde sea utilizada con fines de intermediación laboral, investigación de mercado laboral, evaluación del servicio y estadística de las personas y empresas usuarias del servicio.
Veracidad de la información
Uno de los requisitos fundamentales para el uso de la sección de Luca Laboral es la veracidad de lo que se publique. Por consiguiente, todos los datos que usted incluya tienen que ser reales y ajustarse a la legalidad vigente.
Para Luca Center resulta complicado controlar todas y cada una de las ofertas que se publican. No obstante, Luca Center se reserva el derecho de revisar periódicamente todo tipo de publicación para asegurarse de que estas reglas de uso se están cumpliendo.
Uso de Fotografías
Las fotografías que usted puede utilizar en la sección de Luca Laboral deben servir para identificarse claramente con respecto al resto de usuarios de la web y para mejorar su oferta de empleo o resumé. Dado que no podemos revisar todas las fotos que utilizan nuestros usuarios, Luca Center no asume la responsabilidad de los contenidos ni confirmamos la propiedad de los derechos de autor de las imágenes utilizadas. De este modo, es tu responsabilidad tener los derechos y permisos necesarios para publicarlas.
No obstante, y para asegurar el nivel de calidad, Luca Center se reserva el derecho de revisar y eliminar las fotos que no consideremos oportunas o que otros usuarios hayan denunciado.
Contenido Inapropiado
Se prohíbe el uso de expresiones racistas, étnicas, políticas, políticas partidistas y sexuales que sean detrimentales o que muestren discrimen de algún tipo.
Violación a las Reglas de Uso
Cualquier publicación que no cumpla con lo dispuesto en estas Reglas de Uso, puede ser reportado enviando un correo electrónico a info@lucacenter.com. Cualquier persona que publique algún contenido en violación a lo aquí dispuesto se expone a que se le restrinja el acceso a todos los servicios provistos por Luca Center.

Alcance
Estas reglas de uso sobre Luca+ aplicarán no solo a la sección de nuestra Red Social, sino que tambien aplicará a nuestras secciones de Grupos y Foros.
Pago por el Uso del Servicio
Uno de los servicios que ofrece Luca Center es el pertener a la comunidad de Luca+. EL propósito de esta comunidad es permitir que las personas se conecten y hagan crecer su negocio.
Luca Center no cobra por el uso de la sección de Luca+. Por el contrario, los negocios y las organizaciones nos pagan para que te mostremos anuncios de sus productos y servicios. Al usar nuestros Productos, aceptas que podemos mostrarte anuncios que consideremos que te resultarán relevantes para ti y tus intereses. Usamos tus datos personales como ayuda para determinar qué anuncios mostrarte.
Luca Center no venderá tus datos personales a los anunciantes ni compartimos información que te identifique directamente (como tu nombre, dirección de correo electrónico u otra información de contacto) con los anunciantes, a menos que nos des tu permiso expreso. Por el contrario, los anunciantes pueden proporcionarnos datos como el tipo de público que quieren que vea sus anuncios, y nosotros mostramos esos anuncios a las personas que pueden estar interesadas en ellos. Proporcionamos a los anunciantes informes sobre el rendimiento de sus anuncios para ayudarlos a entender cómo interactúan las personas con su contenido.
Opiniones Vertidas en Luca+
Los usuarios asumen la responsabilidad por sus opiniones y acciones en nuestra comunidad. Por esto, Luca Center le requiere a sus usuarios que:
- Utilicen el mismo nombre que usas en la vida cotidiana.
- Brinden información precisa sobre su persona.
- Creen solo una cuenta (propia) y usen la biografía para fines personales.
- No compartan su contraseña, concedan acceso a tu cuenta a otros ni transfieran a nadie su cuenta (sin nuestro permiso).
Limitación para usar Luca+
- Eres menor de 13 años.
- Eres un delincuente condenado por delitos sexuales.
- Inhabilitamos previamente tu cuenta porque incumpliste nuestras condiciones o políticas.
- Las leyes aplicables prohíben que recibas nuestros productos, servicios o software.
Qué contenido puedes compartir y qué actividades puedes realizar
Queremos que nuestros usuarios se expresen y compartan contenido que le resulte importante, pero sin poner en peligro la seguridad y el bienestar de otras personas ni perjudicar la integridad de nuestra comunidad. Por lo tanto, aceptas no participar en las conductas que se describen a continuación (ni ayudar o apoyar a otros para que lo hagan).
- No puedes usar nuestros Productos para realizar actividades o compartir contenido:
- Que incumplan estas Condiciones, nuestras normas comunitarias y otras condiciones y políticas que rijan el uso de Luca Center.
- Que sean ilegales, engañosos, discriminatorios o fraudulentos.
- Que infrinjan los derechos de otras personas, incluidos los derechos de propiedad intelectual.
- No puedes subir virus o códigos maliciosos, ni realizar actividades que puedan impedir, sobrecargar o afectar el correcto funcionamiento de nuestros productos, o afectar su aspecto.
- No puedes acceder a datos de nuestros productos ni recopilarlos con medios automatizados (sin nuestro permiso previo), ni intentar acceder a datos si no tienes el permiso correspondiente para hacerlo.
Podemos eliminar o restringir el acceso a contenido que infrinja estas disposiciones.
Si eliminamos contenido que compartiste debido a una infracción de nuestras normas comunitarias, te avisaremos y explicaremos las opciones que tienes para solicitar otra revisión, a menos que infrinjas estas Condiciones de forma grave o reiterada o, al hacerlo, nos expongamos o expongamos a otros a una responsabilidad legal; dañemos nuestra comunidad de usuarios; comprometamos la integridad o el funcionamiento de alguno de nuestros servicios, sistemas o Productos, o interfiramos con ellos; estemos restringidos por limitaciones técnicas; o tengamos prohibido hacerlo por motivos legales.
Para contribuir con nuestra comunidad, te recomendamos que reportes contenido o cualquier comportamiento que consideres que infringe tus derechos (incluidos los derechos de propiedad intelectual) o incumple nuestras Condiciones y Políticas.
Los permisos que nos concedes
Para proporcionar nuestros servicios, necesitamos que nos concedas determinados permisos:
- Permiso para usar contenido que creas y compartes. Es posible que cierto contenido que compartas o subas, como fotos o videos, esté protegido por leyes de propiedad intelectual.
- Eres el propietario de los derechos de propiedad intelectual (como derechos de autor o marcas comerciales) de todo el contenido que crees y compartas en Luca Center.
- Sin embargo, para proporcionar nuestros servicios, debes concedernos algunos permisos legales (conocidos como “licencias”) para usar este contenido. Esto es exclusivamente para proporcionar y mejorar nuestros productos y servicios.
- En concreto, cuando compartes, publicas o subes contenido que se encuentra protegido por derechos de propiedad intelectual en nuestros Productos, o en relación con ellos, nos otorgas una licencia internacional, libre de regalías, sub-licenciable, transferible y no exclusiva para alojar, usar, distribuir, modificar, publicar, copiar, mostrar o exhibir públicamente y traducir tu contenido, así como para crear trabajos derivados de él. En otras palabras, si compartes una foto en Luca Center, nos concedes permiso para almacenarla, copiarla y compartirla con otros, como proveedores de servicios que usan nuestros servicios. Esta licencia caduca cuando tu contenido se elimina de nuestros sistemas.
- Puedes eliminar contenido de forma individual o todo junto a la vez eliminando tu cuenta.
- Cuando eliminas contenido, los demás usuarios dejan de verlo. Sin embargo, puede seguir existiendo en otras partes de nuestros sistemas donde:
- no es posible eliminarlo de forma inmediata debido a limitaciones técnicas (en cuyo caso, tu contenido se eliminará en un plazo máximo de 90 días a partir de la fecha de su eliminación);
- otros hayan usado tu contenido en virtud de esta licencia y esas personas no lo hayan eliminado (en cuyo caso, esta licencia se seguirá aplicando hasta que el contenido sea eliminado); o
- la eliminación inmediata restringiría nuestra capacidad para:
- investigar o identificar actividades ilegales o infracciones de nuestras Condiciones o Políticas (por ejemplo, para identificar o investigar el uso indebido de nuestros Productos o sistemas);
- cumplir con una obligación legal, como la preservación de pruebas; o
- cumplir con una solicitud de una autoridad judicial o administrativa, fuerzas del orden o una agencia gubernamental;
- Con respecto a lo dispuesto en este inciso (e)(iii), el contenido se retendrá únicamente durante el tiempo que sea necesario para el fin en cuestión (la duración exacta variará según cada caso).
- En cada uno de los casos anteriores, esta licencia seguirá vigente hasta que el contenido se haya eliminado por completo.
- Permiso para usar tu nombre, foto del perfil e información sobre las acciones que realizas con anuncios y contenido patrocinado. Nos concedes permiso para usar tu nombre y foto del perfil e información sobre las acciones que realizas en Luca Center junto a anuncios, ofertas y otro contenido patrocinado que mostramos en nuestros Productos, o en relación con ellos, sin que recibas compensación de ningún tipo.
- Permiso para actualizar el software que usas o descargas. Si descargas o usas nuestro software, nos concedes permiso para descargar e instalar actualizaciones del software, donde corresponda.
Nombre de Usuario
Te informamos que es posible que tengamos que cambiar el nombre de usuario de tu cuenta en determinadas circunstancias. Por ejemplo, si alguien más reclama el nombre de usuario y no parece guardar relación con el nombre que usas en tu vida cotidiana.
Límites en cuanto al uso de la propiedad intelectual
Si usas contenido protegido por derechos de propiedad intelectual que poseemos y ponemos a disposición en nuestros Productos, tales como imágenes, diseños, videos o sonidos que ofrecemos y que tú agregas al contenido que creas o compartes en Luca Center, nos reservamos todos los derechos sobre dicho contenido (pero no sobre los tuyos). Solo puedes usar nuestros derechos de autor o nuestras marcas comerciales o cualquier marca similar según lo permiten nuestras Normas de uso de marca de forma expresa o con nuestro permiso previo por escrito. Debes obtener nuestro permiso por escrito (o un permiso en virtud de una licencia de código abierto) para modificar, descompilar o intentar de algún otro modo extraer nuestro código abierto, o crear trabajos derivados de él.
Violencia e Incitación
Nos esforzamos por prevenir daños en la vida real que puedan estar relacionados con contenido en Luca Center. Si bien entendemos que las personas suelen expresar desprecio o desacuerdo mediante amenazas o apelaciones a la violencia sin intenciones serias, eliminamos el lenguaje que incita o da lugar a actos graves de violencia. En los casos en los que consideramos que existe riesgo real de daños físicos o amenazas directas a la seguridad pública, eliminamos el contenido, inhabilitamos las cuentas y colaboramos con las autoridades competentes. También intentamos tener en cuenta el lenguaje y el contexto para distinguir afirmaciones casuales de contenido que constituya una amenaza creíble a la seguridad pública o privada. Para determinar si una amenaza es creíble, también podemos tener en cuenta otros datos, como la visibilidad pública y el riesgo para la seguridad física de una persona.
En algunos casos, observamos amenazas condicionales o expresiones de deseo dirigidas a terroristas o a otras personas violentas (como “Hay que matar a todos los terroristas”), pero las consideramos no creíbles ante la ausencia de pruebas que demuestren lo contrario.
Personas y organizaciones peligrosas
Para evitar y prevenir daños en la vida real, no permitimos la presencia en Luca Center de ninguna persona u organización que reivindique una misión violenta o cometa actos de violencia. Esto incluye lo siguiente:
- Actividades terroristas
- Odio organizado
- Asesinato en serie o en masa (lo que incluye intentos de asesinato)
- Trata de personas
- Crimen organizado o actividades delictivas
También eliminamos el contenido que apoye o elogie a grupos, líderes o personas implicadas en estas actividades.
Promoción o publicidad de la delincuencia
Prohibimos promocionar o anunciar crímenes violentos, robos o fraudes porque no aprobamos este tipo de actividad y otras personas podrían imitar ese tipo de comportamiento. Tampoco permitimos que las personas muestren actos criminales ni admitan crímenes que ellas o personas relacionadas con ellas cometieron. No obstante, sí permitimos a la gente debatir o defender la legalidad de las actividades delictivas, así como referirse a ellas en un tono retórico o satírico.
Organización de actos para infringir daños
Con el fin de evitar y obstaculizar la ejecución de daños reales, no permitimos que las personas faciliten u organicen actividades criminales futuras que pretendan o puedan causar daños a personas, negocios o animales. Las personas pueden llamar la atención sobre actividades perjudiciales de las que fueron testigos o que experimentaron, siempre que no defiendan ni organicen actos para infringir daños.
Artículos regulados
Para fomentar la seguridad y el cumplimiento de las prohibiciones legales comunes, no permitimos que individuos, fabricantes o minoristas compren, vendan o intercambien drogas, fármacos ni marihuana. Tampoco permitimos la compra, venta, obsequio, intercambio y traspaso de armas de fuego, incluidas partes o municiones.
Admitimos conversaciones sobre la venta de armas de fuego o partes de armas de fuego en tiendas físicas o en internet y que aboguen por cambios en la regulación de las armas de fuego.
Fraude y engaño
En un esfuerzo por prevenir e interrumpir actividades dañinas o fraudulentas, eliminamos contenido cuyo fin sea engañar intencionalmente a las personas para obtener una ventaja o privar a alguien de dinero, propiedades o derechos legales. No obstante, permitimos que las personas concienticen y eduquen a otras al respecto y condenen estas actividades en nuestra plataforma.
Suicidio y autolesiones
Con el fin de promover un entorno seguro, eliminamos el contenido que fomente el suicidio o las autolesiones, incluidas ciertas imágenes gráficas y demostraciones en tiempo real que los especialistas consideran que pueden animar a otros a imitar dicho comportamiento. Una autolesión se define como un daño intencional y directo al cuerpo propio, incluida la automutilación y los trastornos alimenticios. Como queremos que Luca Center sea un espacio donde las personas puedan compartir sus experiencias, generar conciencia sobre estos problemas y buscar apoyo mutuo, permitimos que las personas hablen sobre el suicidio y las autolesiones.
Por otro lado, eliminamos cualquier contenido que identifique o señale negativamente a víctimas o sobrevivientes de autolesiones o suicidio, ya sea en tono serio, humorístico o retórico.
Desnudos y explotación sexual de menores
No admitimos contenido donde se explote sexualmente o donde se ponga en peligro a niños. Cuando advertimos una aparente explotación infantil, la reportamos a las agencias pertinentes. Sabemos que algunas veces las personas comparten desnudos de sus propios hijos sin una mala intención. Sin embargo, solemos eliminar estas imágenes porque pueden plantear un riesgo potencial de abuso por parte de otros y para evitar que otras personas las reutilicen o roben.
Explotación sexual de adultos
Con el fin de crear un espacio adecuado para este tipo de conversaciones y promover un entorno seguro, eliminamos contenido que muestre o promueva violencia, agresiones o explotación sexuales, o que constituya amenazas de este tipo. No obstante, permitimos que haya un espacio para que las víctimas compartan sus experiencias. Eliminamos contenido que muestre, apoye u organice actos sexuales con personas contra su voluntad o servicios sexuales de carácter comercial, como prostitución o servicios de acompañantes. Nuestra meta es imposibilitar transacciones que pudieran involucrar trata, coerción y actos sexuales sin consentimiento.
Para proteger a víctimas y sobrevivientes, también eliminamos fotos que muestren incidentes de violencia sexual e imágenes íntimas compartidas sin el permiso de la persona retratada.
Bullying y acoso
El bullying y el acoso ocurren en muchos lugares y se presentan de diversas formas, como amenazas, divulgación de información de identificación personal, envío de mensajes amenazantes y contactos no deseados con intención maliciosa. No toleramos este tipo de comportamiento porque impide que las personas se sientan seguras y respetadas en Luca Center.
Hacemos una distinción entre las figuras públicas y las personas no públicas porque queremos dar lugar al diálogo, que a menudo incluye comentarios críticos de personas que aparecen en las noticias o tienen un público amplio. En el caso de las figuras públicas, eliminamos los ataques graves y algunos en los que se etiqueta a la figura pública directamente en la publicación o el comentario. En lo que respecta a las personas no públicas, nuestra protección es aún mayor. Eliminamos el contenido destinado a humillar o avergonzar, por ejemplo, declaraciones sobre la actividad sexual de alguien.
El contexto y la intención son importantes, por lo que permitimos que las personas compartan y vuelvan a compartir publicaciones cuando está claro que el objetivo es condenar el bullying y el acoso, o llamar la atención sobre estos temas. En algunas ocasiones, solicitamos que la persona que es victima de bullying o acoso reporte la situación porque nos permite saber que se siente afectada.
Explotación de personas
En un esfuerzo por intervenir y evitar daños, eliminamos contenido que facilite o coordine la explotación de seres humanos, lo que incluye la trata de personas. Definimos la trata de personas como un negocio en el que se priva a alguien de su libertad con el fin de obtener una ganancia. Se trata de la explotación de personas para forzarlas a participaren actividades de sexo comercial, laborales o de otro tipo en contra de su voluntad. Se basa en el engaño, el uso de la fuerza y la coerción, y atenta contra la integridad de las personas, ya que las priva de su libertad mientras otros se benefician económica o materialmente.
La trata de personas tiene varias facetas y es un problema mundial. Cualquiera puede ser víctima, independientemente de la edad, el nivel socioeconómico, la etnia, el sexo o el lugar. Adopta diversas formas y cualquier situación de trata concreta puede implicar diversas etapas de desarrollo. Dada la naturaleza coercitiva de este tipo de abuso, se realiza sin el consentimiento de las víctimas.
Infracciones de privacidad y derechos de privacidad de las imágenes
Nos esforzamos arduamente en mantener segura tu cuenta y en salvaguardar tu información personal para protegerte de potenciales daños físicos o económicos. Por tu parte, debes evitar publicar información personal o confidencial de otras personas sin obtener primero su consentimiento. Como recurso adicional, ofrecemos a las personas la opción de reportar imágenes que consideren que infringen sus derechos de privacidad.
Lenguaje que incita al odio
En Luca Center no admitimos el lenguaje que incita al odio porque crea un ambiente de intimidación y exclusión y, en algunos casos, puede fomentar actos violentos en la vida real.
Definimos el lenguaje que incita al odio como un ataque directo a personas según lo que llamamos características protegidas: raza, etnia, nacionalidad, religión, orientación sexual, casta, sexo, género, identidad de género y discapacidad o enfermedad grave. También ofrecemos algunas medidas de protección en relación con la condición de inmigrante. Definimos un ataque como todo discurso violento o deshumanizante, afirmaciones de inferioridad o incitaciones a la exclusión o segregación. Separamos los ataques en tres niveles de gravedad, como se describen a continuación.
Sabemos que a veces las personas comparten contenido de otros que incluye lenguaje que incita al odio con el fin de generar conciencia o educar a otros. En ocasiones, se usan palabras o términos, que de otro modo podrían infringir nuestras normas, de manera autorreferencial o como una forma de empoderamiento. A veces, las personas expresan desprecio en el contexto de una ruptura amorosa. En otras oportunidades, emplean lenguaje sexista para controlar a miembros en un grupo de apoyo o relacionado con la salud, por ejemplo, un grupo de lactancia exclusivo para mujeres. En todos estos casos, permitimos tal contenido, pero esperamos que se indique claramente la intención para que podamos entender mejor por qué se compartió. Cuando la intención no esté clara, es posible que lo eliminemos.
Los comentarios humorísticos y sociales relacionados con estos temas sí están permitidos. Además, creemos que si las personas usan su identidad real son más responsables cuando comparten este tipo de comentarios.
Violencia y contenido gráfico
Eliminamos el contenido que enaltece la violencia o celebra el sufrimiento o la humillación de otras personas, ya que puede crear un entorno que disuada la participación. Permitimos el contenido gráfico (con algunas restricciones) para ayudar a las personas a generar conciencia sobre algunos temas. Sabemos que las personas valoran la posibilidad de debatir temas importantes, como la vulneración de los derechos humanos o los actos de terrorismo.
Desnudos y actividad sexual de adultos
Restringimos la exhibición de desnudos o actividades sexuales porque este tipo de contenido puede resultar sensible para algunas personas de nuestra comunidad. Además, de forma predeterminada eliminamos imágenes sexuales para evitar que se comparta contenido sin permiso o de menores de edad. Las restricciones sobre la exhibición de actividades sexuales también se aplican al contenido digital, a menos que se publique con fines educativos, humorísticos o satíricos.
Con el transcurso del tiempo, nuestras políticas sobre desnudos se van matizando. Entendemos que las personas comparten desnudos por una variedad de razones, entre ellas, como una forma de protesta, para generar conciencia sobre una causa o por razones educativas o médicas, y aceptamos el contenido cuando dicha intención es evidente. Por ejemplo, aunque restringimos las fotos de senos femeninos que muestren el pezón, sí permitimos las que representen actos de protesta, a mujeres amamantando activamente y fotos de cicatrices de mastectomías. También permitimos fotografías de pinturas, esculturas y otras obras de arte donde se muestren figuras desnudas.
Servicios sexuales
Las personas que utilicen Luca Center para debatir y llamar la atención sobre la violencia y la explotación sexual deben expresarse con respeto. Reconocemos la importancia de este debate y queremos fomentarlo. No obstante, nos reservamos a retirar cualquier publicación cuando el contenido facilita, fomenta o coordina encuentros sexuales entre adultos. También restringimos el lenguaje sexual explícito que pueda conducir a servicios sexuales, ya que algunos públicos de nuestra comunidad internacional pueden ser sensibles a este tipo de contenido y podría impedir que las personas se conecten con sus amigos y el resto de la comunidad.
Contenido cruel e insensible
Creemos que las personas comparten y se conectan con más libertad cuando no se sienten blancos de ataques basados en lo que las hace sentir vulnerables. Por lo tanto, tenemos expectativas más altas sobre el contenido que consideramos como cruel e insensible, definido como el contenido que señala a víctimas de daños físicos o emocionales graves.
Eliminamos los intentos explícitos de burlarse de las víctimas y marcamos como crueles los intentos implícitos, muchos de los cuales adoptan la forma de memes o GIF. Asimismo, eliminamos cualquier expresión de sadismo contra personas o animales.
Spam
Nos esforzamos arduamente para limitar la difusión de spam comercial con el fin de evitar publicidad falsa, fraudes y violaciones a la seguridad, que evitan que las personas compartan y se conecten. No permitimos que las personas usen información engañosa o imprecisa para aumentar el número de me gusta, amigos o veces que se comparta el contenido.
Representaciones engañosas
La autenticidad es la piedra angular de nuestra comunidad. Creemos que las personas actúan y se expresan de modo más responsable cuando usan su identidad real. Por eso, les pedimos a las personas que se conectan que usen el nombre por el que todos las conocen. Nuestras políticas de autenticidad buscan crear un entorno seguro donde las personas puedan confiar y hacerse responsables mutuamente.
Noticias falsas
Nos tomamos muy en serio la responsabilidad de disminuir la difusión de noticias falsas en Luca Center. Somos conscientes de que este tema es complejo y delicado. Queremos ayudar a las personas a mantenerse informadas sin suprimir el debate público productivo. Hay una línea muy delgada entre las noticias falsas y las sátiras o las opiniones. No obstante, nos reservamos el derecho a eliminar cualquier noticia que entendamos sea falsa.
Cuentas conmemorativas
Cuando alguien fallece, sus amigos y familiares pueden solicitar que convirtamos su cuenta en conmemorativa, y, para ello, agregamos la frase “En memoria de” encima del nombre de la persona en su perfil. De esta forma, queda claro que la cuenta es un sitio de homenaje y se la protege frente a intentos de inicio de sesión no deseados y actividades fraudulentas. No eliminamos, actualizamos ni cambiamos nada del perfil ni la cuenta porque queremos respetar las elecciones que la persona hizo en vida. Por otro lado, las personas también tienen la opción de designar a un contacto de legado que pueda cuidar de su cuenta después de su fallecimiento. Las personas nos pueden avisar con anticipación si quieren que su cuenta se elimine definitivamente cuando mueren. Es posible que eliminemos un perfil si el familiar más cercano del fallecido nos informa que esa persona hubiera preferido que elimináramos su cuenta en lugar de convertirla en conmemorativa.
Comportamiento no auténtico
En consonancia con el compromiso que asumimos con la autenticidad, no permitimos que las personas se representen a sí mismas de forma engañosa en Luca Center, usen cuentas falsas, aumenten la popularidad del contenido por medios artificiales o participen en comportamientos que den lugar a otras infracciones en virtud de nuestras Normas comunitarias. Esta política tiene como fin crear un espacio en el que las personas puedan confiar en los demás y en las comunidades con las que interactúan.
Propiedad intelectual de Terceros
Luca Center se toma muy en serio los derechos de propiedad intelectual y considera que son importantes para fomentar la expresión, creatividad e innovación en nuestra comunidad. Tú eres el propietario de todo el contenido y la información que publicas y controlas cómo se comparte a través de la configuración de la privacidad y de las aplicaciones.
Sin embargo, antes de compartir contenido, asegúrate de que estás autorizado a hacerlo. Te pedimos que respetes los derechos de autor, las marcas comerciales y otros derechos de propiedad intelectual de otras personas. Nos comprometemos a ayudar a las personas y organizaciones a promover y proteger sus derechos de propiedad intelectual.
Las Condiciones del servicio de Luca Center prohíben que se publique contenido que infrinja los derechos de propiedad intelectual de otras personas, incluidos los derechos de autor y de marca comercial.
Suspensión o cancelación de la cuenta
Queremos que Luca Center sea un lugar donde las personas se sientan bienvenidas y seguras para expresarse y para compartir sus ideas y opiniones.
Si determinamos que incumpliste nuestras Condiciones o Políticas en reiteradas oportunidades o de una manera notoria o grave, incluidas en particular nuestras Normas comunitarias, podemos suspender o inhabilitar definitivamente el acceso a tu cuenta. También podemos suspender o inhabilitar tu cuenta si infringes reiteradamente los derechos de propiedad intelectual de otras personas o en los casos donde estemos obligados a hacerlo por motivos legales.
Cuando tomemos tal medida, te avisaremos y explicaremos las opciones que tienes para solicitar una revisión, a menos que, al hacerlo, nos expongamos o expongamos a otros a una responsabilidad legal; dañemos nuestra comunidad de usuarios; comprometamos la integridad o el funcionamiento de alguno de nuestros servicios, sistemas o Productos, o interfiramos con ellos; estemos restringidos por limitaciones técnicas; o tengamos prohibido hacerlo por motivos legales.
Puedes ponerte en contacto con nosotros si consideras que inhabilitamos tu cuenta por error para aclarar cualquier situación.
Límites de responsabilidad
Nos esforzamos por proporcionar los mejores Productos posibles y definir pautas claras para todos aquellos que los usen. No obstante, nuestros Productos se proporcionan tal como están y no podemos garantizar que siempre serán seguros, nunca tendrán errores o funcionarán sin interrupciones, demoras o imperfecciones. En la medida en que la ley lo permita, también RENUNCIAMOS A TODA GARANTÍA, EXPRESA O IMPLÍCITA, INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN PARTICULAR, TÍTULO Y NO INFRACCIÓN. No controlamos ni dirigimos lo que las personas u otros hacen o dicen, ni somos responsables por sus acciones o conductas (dentro o fuera de internet) ni por el contenido que comparten, incluido contenido ofensivo, inapropiado, obsceno, ilegal o cuestionable.
No podemos predecir cuándo puede surgir un problema con nuestros Productos. En consecuencia, nuestra responsabilidad se limitará al máximo alcance que la ley aplicable permita, y bajo ninguna circunstancia seremos responsables anti ti por la pérdida de ganancias, ingresos o información, ni por daños consecuentes, especiales, indirectos, ejemplares, punitivos o incidentales que surjan a raíz de estas Condiciones o los Productos de Luca Center, o en relación con ellos, incluso si se nos advirtió sobre la posibilidad de que ocurran dichos daños. Nuestra responsabilidad total derivada de estas Condiciones o los Productos de Luca Center, o en relación con ellos, no podrá exceder el valor de $100 USD o el importe que nos hayas pagado en los últimos doce meses, el que sea mayor.

Compatibilidad
Los documentos pueden haber sido creados con formatos distintos de Microsoft Word, Excel, PowerPoint, PDF, entre otros. Luca Center no garantiza compatibilidad con otras aplicaciones que no sea la versión utilizada para crear el documento.
Sin embargo, Luca Center ha probado los documentos con diversas versiones de aplicaciones de WORD, y otros procesadores de palabras logrando una conversión casi idéntica y sin problema alguno. Debe tener en consideración que distintas aplicaciones pueden interpretar data de manera distinta, y por ende, existe el riesgo de afectar el formato de la composición del documento.
Uso de los Templates
Al descargar, comprar y/o solicitar cualquier modelo de documento en Luca Center acepta que los mismos son solo modelos de documentos a ser ajustados por usted, quien lo descarga o compra, según sea su caso.
Los Templates de Luca Center no se deben considerarse un orientación legal o contributiva. Por consiguiente, estos solo sirven de ayuda para la edición del documento y/o incluyen información pública de requisitos de agencias/entidades gubernamentales y/o privadas.

Propiedad Intelectual

Desarrollo y Actualización del Curso Los talleres y cursos presenciales ofrecidos por LUCA CENTER para crédito de Educación Profesional Continua se desarrollarán e impartirán por personas o equipos que tienen la experiencia en la materia. Dicha experiencia se habrá demostrado a través de la experiencia y / o formación práctica
Todos los cursos utilizarán actividades, materiales y sistemas de enseñanza que estén al día, técnicamente correctos, diseñado de manera efectiva y contará con las fechas recientes de publicaciones o revisiones y actualizaciones. Los cursos serán revisados anualmente (o con mayor frecuencia si es necesario debido a la materia) por una persona capacitada o un equipo diferente a los que desarrollaron el contenido del curso. De esta manera se mantiene un contenido actualizado con la ayuda de la claridad técnica, las evaluaciones de los asistentes, y la retroalimentación de anécdotas.
Luca Center utilizará al menos un CPA en el desarrollo o actualización de todos los programas que la materia en contabilidad y auditoría.
Luca Center utilizará al menos un abogado o un CPA en el desarrollo o actualización de otros temas.
Nivel de Conocimiento
Los talleres y cursos ofrecidos por LUCA CENTER serán desarrollados de manera consistente con el pre-requisito y la experiencia de los participantes. Nuestros cursos se clasificarán en: · Básico;· Intermedio;· Avanzado; y · Actualizaciones, o repasos. De esta manera los participantes pueden determinar si los cursos son apropiados para sus necesidades de desarrollo profesional. Los requisitos de experiencia y de educación se incluirán en los materiales descriptivos del programa.
Objetivos de Aprendizaje y Resultados
El objetivo principal de aprendizaje es aumentar el entendimiento de los participantes a través de la discusión con expertos, esclarecimiento y cuestionamiento interactivo. Los talleres y los programas están diseñados para que los alumnos ejerzan un entendimiento práctico de los argumentos, así como los últimos cambios en un sector complejo y en continuo cambio. Las actividades de aprendizaje se basan en objetivos pertinentes de aprendizaje y los resultados que articulan claramente los conocimientos, destrezas y habilidades que se pueden alcanzar por los participantes en las actividades de aprendizaje. Como regla general, no hay requisitos previos o requisitos de preparación por adelantado para los cursos de LUCA CENTER.
Monitoreo de Asistencia
Para garantizar el cumplimiento de las normas de NASBA para la retención de información y registro de créditos de Educación Profesional Continua, LUCA CENTER se adhiere los siguientes criterios de asistencia:
- Se requiere una hoja de registro para todos los programas en los que se ofrece crédito de Educación Profesional Continua;
- Los participantes recibirán un formulario de registro de crédito Educación Profesional Continua para señalar la participación del taller;
- Los participantes deben registrarse a su llegada y anotar el número de línea que firmaron en su formulario de registry;
- Los participantes deben escuchar o estar pendiente de un código que se le dará al azar durante la sesión y tomar nota de dicho código en el formulario de registro;
- A la conclusión del seminario, talleres o cursos los participantes presentarán sus formularios de registro a LUCA CENTER para ser inspeccionados por el cumplimiento y que se comparan con la hoja de registry;
- Cada programa será supervisado por al menos un coordinador del taller que le dará la bienvenida a los participantes a medida que llegan y asegurará que los procedimientos se cumplen;
- Certificados sólo se emitirán tras la verificación de la asistencia.
Horas completas serán acreditadas a los participantes si él / ella se registra en o antes del inicio del curso. Si el participante llega después de 15 minutos del inicio del curso, se reducirán las horas acreditadas; dicha reducción será en incrementos de 30 minutos. Materiales Los materiales para esta actividad educativa se distribuirán por medios electrónicos. Podrá accederlos a través de la página electrónica de Luca Center, donde estarán disponible hasta cinco días después del evento. Evaluación Una vez haya terminado el seminario, usted deberá presentar una evaluación del curso, el cual nos permitirá mejorar los servicios educativos que le ofrecemos.
Retención de Registros
LUCA CENTER conservará los registros del curso durante cinco años. Estos registros incluirán los siguientes:
- Esquema del curso;
- Lista de participantes del curso;
- Fechas y lugares de las presentaciones;
- Nombres de los instructores / persona que dirige la discusión y sus credenciales;
- Copias de las evaluaciones de los participantes del curso y
- Cantidad de crédito recomendado por Educación Profesional Continua.
Reserva de Cursos
Las reservaciones a los seminarios presenciales de Luca Center solamente se aceptarán con el pago por adelantado. No se reservarán espacios sin pago. Como regla general no se aceptarán pagos en puerta. En caso de alguna excepción, los pagos en puertas conllevarán un cargo adicional de $10 sin distinción de personas. Pagos por correo deben enviarse con suficiente tiempo de anticipación para asegurarse que sea recibido antes de la fecha del seminario. Los espacios para nuestros seminarios presenciales son limitados. Por consiguiente, la matrícula al mismo estará sujeta a cupo sin importar que su membresía incluya acceso ilimitado a todos nuestros seminarios. Luca Center realizará la reserva de los espacios disponibles por orden de fecha (utilizando como método el “first come first served”).
Cargo por Cheque Devuelto
Todo cheque devuelto tendrá un cargo de $25 sin distinción de personas.
Créditos y Reembolsos
Para los miembros de Luca Center no habrá reembolso ya que los cursos son libre de costo.
Para los cursos vendidos se debe realizar una solicitud de cancelación cinco días antes del curso para recibir un reembolso completo. Las solicitudes procesadas con menos de cinco días a la fecha del seminario se les otorgará un crédito. Todo crédito tiene una vigencia de tres meses. Otra persona le puede substituir en el caso de no poder asistir. De ausentarse, perderá el costo del curso.
Cancelaciones el mismo día del seminario o en días siguientes al seminario no conllevan devolución de dinero ni crédito.
Conferencias o foros especiales podrían tener una política de cancelación diferente. En estos casos, se aplicarán las condiciones de cancelación de las conferencias o foro publicadas.

Cambio de Instructores o Cancelaciones de Cursos
Luca Center se reserva el derecho a sustituir instructores y a suspender un curso debido a matrícula insuficiente y otras causas ajenas a nuestro control.
Derecho de Admisión
Nos reservamos el derecho de admisión.
Grabaciones de Cursos
Usted reconoce que los cursos presenciales podrían ser grabados mediante cámara de vídeo el día de la conferencia y puestos posteriormente como cursos en línea. Al usted tomar y participar de un curso presencial que vaya a ser grabado y/o esté siendo grabado mediante cámara de vídeo, usted voluntaria y expresamente acepta que el audio y las imágenes de lo que se diga y ocurra durante el curso sean grabadas y autoriza a Luca, LLC a poner dicha grabación (incluye imagen y audio) como curso en línea.
Además, usted acepta que no tendrá derecho a compensación monetaria y/o económica alguna por concepto de dicha grabación y su posterior publicación y releva y exime a Luca, LLC de todo reclamo que usted tenga o pueda tener por razón de la publicación en línea de la grabación, incluyendo pero sin limitarse a, reclamos sobre el derecho a la propia imagen.
De usted no estar de acuerdo con que se grabe un curso presencial es su obligación no asistir al curso y solicitar reembolso del dinero si pagó por dicho curso.
Propiedad Intelectual
Usted no podrá, por sí ni a través de terceros, copiar, duplicar, modificar, manipular, ni distribuir vídeos, grabaciones, códigos y/o material escrito para ningún propósito sin autorización escrita previa de Luca, LLC. Tampoco podrá grabar para ningún propósito los cursos sin la autorización escrita de Luca, LLC.
Cancelación de Programas
LUCA CENTER puede, a su discreción, cancelar o substituir un programa previamente anunciado por un programa de contenido similar. LUCA CENTER hará todo lo posible para proporcionar la notificación suficiente de un cambio de tema o de cancelación. LUCA CENTER proveerá reembolso en aquellos casos que se haya producido una cancelación del curso sin suministrar ningún curso alterno.
Resoluciones de Quejas

Reglas Aplicables a los Live Webinars
1. Nuestro portal funciona con el navegador Google Chrome. Además, el mismo también pudiera funcionar con otros navegadores modernos, tales como, Mozilla Firefox, Microsoft Edge y MacOS Safari.
2. Los Live Webinars será administrados a través de la plataforma de Zoom.
3. Los materiales del curso se encontrarán disponibles en la sección del seminario (en formatos pdf) para que cada usuario pueda descargarlos a su conveniencia.
4. Para que un curso se considere completado, un usuario debe completar las “Lecciones”. Una vez completado el 100% del curso, Luca Center procederá con el trámite de acreditación del mismo.
5. La fecha de acreditación del curso será la fecha en que se ofreció el Seminario Virtual En Vivo.
6. Las preguntas realizadas a través del Chat, Q&A o cualquier otro método habilitado por Luca Center podrán ser discutidas en vivo durante el seminario o publicadas en el chat para que se beneficien de la misma los demás participantes. En estos casos, Luca Center podrá, a su discreción: (a) leer su pregunta, (b) resumir su pregunta, (c) mencionar el nombre del participante que la realiza.
7. Es importante que todo participante mantenga un buen comportamiento durante el seminario. Las Reglas de Uso de Luca+ aplicarán en cuanto al comportamiento aplicable durante la transmisión del seminario.
8. En la descripción de cada Live Webinar se incluirá unas instrucciones aplicables a dicho evento. Dichas instrucciones formarán partes de estas Políticas de Seminarios Online.
Reglas Aplicables a los Seminarios On Demand

3. Para que un curso se considere completado, un usuario debe completar todas las “Lecciones” (no será requerido que se complete en el orden programado). Una vez completado el 100% del curso (incluyendo todos sus quizzes y cuestionarios), Luca Center procederá con el trámite de acreditación del mismo.
4. La fecha de acreditación del curso se realizará según la fecha en que el usuario complete el mismo y no será la fecha de matrícula al Seminario On Demand.
5. Los usuarios deben completar el seminario antes de la fecha de vencimiento del curso o un (1) año después de la fecha en que se compró el mismo, lo que ocurra primero.
6. Todo usuario que se haya matriculado al curso sin costo alguno (por ejemplo: Miembros Oro), tiene que completar el seminario antes de la fecha de expiración de su membresía y la fecha de expiración del curso para que el mismo sea acreditado. En caso de que su membresía expire antes de completar el curso, el usuario deberá (a) renovar su Membresía Oro; o (b) pagar la acreditación del curso mediante la compra de créditos.
7. A lo largo de la presentación, los usuarios tendrán la oportunidad de poner a prueba sus conocimientos mediante el uso de quizzes. Tenga en cuenta que estas preguntas se proporcionan solo como una ayuda para el aprendizaje y no constituyen un examen final para fines de acreditación del curso.
8. Al finalizar el seminario, aquellos usuarios que deseen obtener la acreditación para fines de NASBA estarán obligados a completar un Examen Final. Para poder obtener la acreditación del curso, el usuario deberá aprobar dicho Examen Final con una calificación mínima de 70%. Las personas que completen este examen no recibirán comentarios sobre las preguntas contestadas correctas o incorrectamente. Aquellos usuarios que reprueben el examen tendrán un número ilimitado de intentos para aprobar el mismo sin tener que pagar algún costo adicional.
Otorgación de Créditos de Educación Continua
Cada curso incluirá en su descripción los créditos de educación continua que usted puede generar una vez termine el curso. Cursos comenzados, pero que no han sido completados, no serán acreditados por Luca Center.
Materiales Los materiales para esta actividad educativa se encontrarán dentro del curso en línea. Evaluación Una vez haya terminado el seminario, usted deberá presentar una evaluación del curso, el cual nos permitirá mejorar los servicios educativos que le ofrecemos.
Retención de Registros
LUCA CENTER conservará los registros durante cinco años. Estos registros incluirán como mínimo lo siguiente:
